TERMS AND CONDITIONS

These terms and conditions “Terms and Conditions” tell you information about us and set out the legal terms and conditions on which we sell any of the Noble Isle products “Products” listed on our website nobleisle.com.au “Website” to you. These Terms and Conditions do not apply if you buy Noble Isle products from any source other than our Website (for example, if you buy Noble Isle products from one of our authorized distributors or retailers). The distributors and retailers will have their own terms and conditions that will apply if you buy Noble Isle products from them.

These Terms and Conditions will apply to any contract for the sale of Products by us to you “Contract”. Please read these Terms and Conditions carefully and make sure that you understand them before ordering any Products from our Website.

Please note that by ordering any of our Products, you agree to be bound by these Terms and Conditions. If you refuse to accept these Terms and Conditions, you will not be able to order Products from our Website.

Understanding these Terms and Conditions

When certain words and phrases are used in these Terms and Conditions, they have specific meanings these are known as “defined terms”. Where a defined term is used, it has the meaning given to it in the section of the Terms and Conditions where it was defined.

When we refer to “we”, “us” or “our”, we mean nobleisle.com.au. When we refer to “you” or “your” we mean you, the person buying Products from our Website. We will not file copies of the Contract between you and us so we recommend that you print or save a copy of these Terms and Conditions for your records (but please note that we may amend these Terms and Conditions from time to time.

Our Products

Noble Isle is a fine fragrance, bath & body brand, inspired by the rich, cultural heritage of the British Isles. The collection is natural, vegan friendly, cruelty-free and made in the UK using extracts from celebrated producers around the British Isles including; Rhubarb from Yorkshire, Samphire from Ireland, Barley from Scotland, and Beetroot from Wales.

We are great believers in the power of fragrance which can take you back to another place or time. At Noble Isle we only use perfumes in our products, in which the evocative scents have captured Britain in a Bottle.

The images of the Products on our Website are for illustrative purposes only. The packaging and presentation of the Products may vary from what shown on images on our Website. All Products shown on our Website are subject to availability. We will inform you by email as soon as possible if the Product you have ordered is not available and we will not process your order if made.

Your account

You do not have to register to explore our Website or to buy Products from us however if you do chose to register and create an account with us this will allow you to fully enjoy our Website and enable us making shopping easier for you. By creating an account you can store your debit and credit card information for easier and fast checkout, store and edit your delivery address and billing information.

When you buy Products or register through our Website, you will be required to provide certain information including your name, phone number and email address. You will also be required to provide valid details of a credit or debit card which you are legally entitled to use. We reserve the right to request additional evidence or proof of billing information where we think this is necessary. You confirm that all information you provide to us at any time is true, accurate and complete.

Purchasing Products from us

You may only purchase Products from our Website if you are at least 18 years old. You may also not buy Products from our Website for business and/or resale purposes. Our order process allows you to check and amend any errors before submitting your order to us therefore please take the time to read and check your order at each page of the order process particularly the quantities you are ordering. By clicking the “Submit order” you are committing to buy, pay for the Products in your order and confirm that you are accepting our Terms and Conditions. 

After you place an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. If we accept your order, we will confirm this to you by sending you an Order Confirmation email. The Contract between us will only be formed when we send you the Order Confirmation. We will send you Shipping Confirmation email when the products in your order have been shipped. If we are unable to supply you with a Product that is not in stock or is no longer available, we will inform you by email and we will not process your order. If you have already paid for the Product(s), we will refund you the full amount as soon as possible.

Product prices

All our prices are GST(Goods and Service Tax) included. The prices of the Products may change from time to time, but changes will not affect any order which we have confirmed with an Order Confirmation email.

Payment Methods

 We accept Paypal and major credit or debit cards like American Express, Visa and MasterCard. By ordering Products from us through our Website you authorise us to perform credit and anti-fraud checks on you and the payment method that you have provided. You authorise us to disclose information provided by you including personal information, to third parties such as banks and the providers of credit reports for the purposes of these checks and accept that such parties may keep a record of that information. 

Delivery

Your order will be delivered by the estimated delivery date set out in the Shipping Confirmation unless there is a reason outside of our control. If we are unable to meet the estimated delivery date by any reason, we will contact you with a revised estimated delivery date. Delivery will be completed when we deliver the Products to the address you gave us therefore, please make sure that the delivery details which you provide are accurate as we are not responsible for failed or delayed deliveries due to your error.

Returns and refunds

If for any reason you are not completely satisfied with your nobleisle.com.au purchase, you may return the product in its original packaging and obtain a refund or exchange within 30 days of purchase. Please contact our customer services team using the form on the Contact Us page of our Website before returning the original products. We will send you an email to confirm that we have received your return request. you will be responsible for the cost of returning the Products to us. You are also responsible for taking reasonable care of the Products until they are returned to us. We recommend that you return them to us using a recommended delivery service and that you keep proof of postage. We will be unable to provide you with a full refund if the Products are not returned to us or if they are damaged when they arrive. Only items purchased from nobleisle.com.au with valid and accompanying order information may be accepted for return or exchange. Refunds will be made against the original debit/credit card used. We cannot accept returned goods that we reasonably believe have been used.

Refund process

If you have chosen a refund, we undertake to refund the purchase amount within 7 working days of receiving the returned product, provided that you have returned the goods in their original condition at our warehouse within 30 days of delivery. You will receive e-mail notification of your refund Noble Isle Australia with our payment reference number. 

Complaints

We hope that you don’t have cause for a complaint but if you do, we want to hear about it so that we can try and resolve it and make sure it doesn’t happen again. Please contact our customer services team using the form on the Contact Us page of our Website.

These Terms and Conditions are governed by Australian law. This means that the Contract for the purchase of Products through our Website, and any dispute or claim arising out of or in connection with it, will be governed by Australian law. Jurisdiction shall lie under all circumstances at the registered office of the firm.

Liability

Noble Isle (Cosmo Trade Pty LTd) shall not be held liable for personal injury or damage to property that may arise through the use of the goods delivered by us. The Customer shall not be entitled to offset claims against Noble Isle (Cosmo Trade Pty Ltd) against any amounts due by him or her.
